Terms of Service

"Platform" means the SSUNDAR web application, APIs, and all associated tools, modules, and services.

"Analysis Modules" means the AI-powered analysis tools available on the Platform, including but not limited to: LD-ROI, Root Cause Analysis (RCA), Training Needs Analysis (TNA), Data Analysis, Skills Gap Analysis, Survey Intelligence, Process Audit, Organisational Health, Vendor Evaluation, Compliance Analysis, Meeting Intelligence, Instructional Design Studio (ID Studio), Research Pro, IdeaMap, Capability Scanner (Cap-Scan), and AI Readiness & Workforce Transformation (AI-Readiness).

"Output" means any report, analysis, document, presentation, or other content generated by the Platform in response to User inputs.

"Plan" (also referred to as "Subscription") means a paid plan granting access to selected Analysis Modules for a fixed access period. Plans are one-time purchases and do not auto-renew.

"User Data" means any information, text, documents, files, or data submitted by you to the Platform.

"Intellectual Property Rights" means patents, copyrights, trademarks, trade secrets, and all other proprietary rights.

You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you meet this requirement.

The Platform is designed for use by professionals across multiple domains including, but not limited to: Learning and Development (L&D) professionals, Human Resources and People Operations teams, Organisational Development practitioners, Process Excellence and Lean/Six Sigma professionals, Business Leaders and C-suite executives, Enterprise Strategy and Consulting personnel, Training Design and Instructional Design specialists, Compliance and Regulatory Affairs teams, Vendor Management and Procurement professionals, Operations and Performance Management teams, and any individual or organisation seeking AI-assisted analysis and decision support.

You agree to provide accurate, current, and complete information during registration and to maintain the accuracy of such information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at legal@ssundar.com of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in any activity that we determine, in our sole discretion, to be harmful to the Platform or other users.

SSUNDAR provides an AI-powered analysis platform comprising sixteen (16) distinct Analysis Modules, each designed to assist professionals in making evidence-based decisions. The Platform leverages large language models (LLMs) and proprietary prompt engineering to generate structured analytical Outputs from User-provided inputs.

The Platform operates on a tiered access model, sold as one-time purchases granting access for a fixed period (30 days for monthly plans, or 365 days for annual plans): (a) Free Tier — limited access to selected modules with usage caps; (b) Starter Plan — access to up to three (3) selected modules; (c) Professional Plan — access to up to six (6) selected modules; (d) Systems Plan — access to all modules including asynchronous and enterprise-grade modules. Plans do not auto-renew; access ends when the purchased period lapses unless you purchase a new period.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time with reasonable notice. We will make commercially reasonable efforts to notify users of material changes affecting paid subscriptions.

4.1 Billing. Plans are sold as a one-time payment granting access for a fixed period (30 days for monthly plans, or 365 days for annual plans). Plans do not auto-renew, and no recurring charge is set up — you will not be charged again unless you choose to purchase a new access period. Prices are displayed at checkout inclusive of applicable local taxes. We support billing in multiple currencies; the final amount charged will reflect the live exchange rate at the time of purchase and any applicable digital services tax for your jurisdiction.

4.2 Payment Processing. All payments are processed through Razorpay. By providing payment information, you authorise SSUNDAR to charge your selected payment method for the one-time plan amount plus applicable taxes. This is a single charge; we do not register a recurring mandate and will not automatically charge your payment method again. SSUNDAR does not store full payment card details; these are held by Razorpay in accordance with PCI-DSS standards.

4.3 Taxes. Prices shown at checkout include applicable digital services taxes (including GST, VAT, SST, JCT, or other local taxes) based on your detected or selected country of purchase. You are responsible for any additional taxes applicable under your local laws that may not be captured at checkout.

4.4 Refund Policy. We offer a 7-day money-back guarantee on your first purchase. Refund requests must be submitted to billing@ssundar.com within 7 days of payment. No refunds are available after 7 days. Refunds are not prorated. Because plans do not auto-renew, there are no future billing cycles to refund or cancel; you retain access to your selected modules until your purchased access period ends.

4.5 Cancellation and Changes. Because plans do not auto-renew, no action is needed to stop being charged. You may mark a plan as not continuing at any time from your account dashboard, which stops renewal reminders; you retain access until your current access period ends. Downgrade and upgrade options may be available; contact support@ssundar.com for assistance. We reserve the right to change pricing for future purchases with reasonable notice.

4.6 Failed Payments. If a payment fails, we will attempt to notify you via email. We reserve the right to suspend access until payment is successfully processed.

You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You must not:

(a) use the Platform to generate content that is defamatory, fraudulent, harassing, harmful, obscene, or otherwise objectionable;

(b) attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code or underlying algorithms of the Platform;

(c) use the Platform to train, fine-tune, or develop competing AI models or products;

(d) resell, sublicense, or commercially redistribute Platform Outputs without explicit written authorisation from SSUNDAR;

(e) upload User Data that infringes any third-party Intellectual Property Rights or contains personally identifiable information of third parties without appropriate consent;

(f) use automated scripts, bots, crawlers, or other automated means to access the Platform beyond the rate limits established by our systems;

(g) attempt to circumvent any access controls, rate limits, usage caps, or security mechanisms of the Platform;

(h) upload malicious code, viruses, or any software designed to damage or interfere with the Platform or other users' systems;

(i) use the Platform for any purpose that violates applicable laws, including data protection laws, export control laws, or anti-money laundering regulations;

(j) share account credentials with third parties or allow multiple individuals to use a single account simultaneously.

6.1 Platform Ownership. The Platform, including its design, architecture, code, AI models, prompt engineering, module frameworks, user interface, and all related Intellectual Property Rights, is owned exclusively by SSUNDAR. Nothing in these Terms transfers any ownership rights in the Platform to you.

6.2 Your Data. You retain ownership of all User Data you submit to the Platform. By submitting User Data, you grant SSUNDAR a limited, non-exclusive, royalty-free licence to process your User Data solely for the purpose of providing the services to you.

6.3 Outputs. Subject to your compliance with these Terms and payment of applicable fees, Outputs generated by the Platform are licensed to you for your internal business use. You may not sell, licence, or publicly distribute Outputs as standalone products without attribution to SSUNDAR.

6.4 DMCA Copyright Policy. SSUNDAR complies with the Digital Millennium Copyright Act (DMCA). Our designated agent is registered with the U.S. Copyright Office (Registration No. DMCA-1073290). If you believe content accessible through the Platform infringes your copyright, send a written notice to legal@ssundar.com including: (a) identification of the copyrighted work; (b) identification of the infringing material and its location; (c) your contact information; (d) a good faith belief statement that the use is not authorised; (e) a statement under penalty of perjury that the information is accurate; and (f) your electronic or physical signature. Upon receipt of a valid notice we will promptly remove or disable access to the material and notify the uploader, who may submit a counter-notice. Repeat infringers will have their accounts terminated.

6.5 Feedback. Any feedback, suggestions, or ideas you provide to SSUNDAR regarding the Platform may be used by SSUNDAR without restriction or compensation to you.

6.6 Trademarks. "SSUNDAR", "EXLPRS", "Judgment-Centered Leadership Design", and associated logos are trademarks of SSUNDAR. You may not use these marks without prior written consent.

7.1 Data Processing. User Data submitted to Analysis Modules is transmitted to third-party AI model providers (currently Google Gemini) for the purpose of generating Outputs. By using the Platform, you consent to this processing. We do not use your User Data to train AI models without explicit consent.

7.2 Data Storage. Your account information, analysis history, and associated Outputs are stored in our database infrastructure (Supabase, hosted on AWS infrastructure in Singapore, region ap-southeast-1). We implement industry-standard security measures including encryption at rest and in transit, row-level security, and access controls.

7.3 Retention Periods. Analysis results and associated inputs are retained for a maximum of 24 months from the date of creation, after which they are automatically deleted. Account information is retained for the duration of your account and for 90 days following account deletion, after which it is permanently erased. Billing records are retained for 7 years in accordance with Indian accounting and tax regulations. Session and authentication logs are retained for 90 days.

7.4 Data Deletion. You may request deletion of your account and all associated data at any time through your dashboard (Settings → Delete Account) or by contacting privacy@ssundar.com. Deletion is permanent and irreversible. Billing records required for legal compliance will be retained as described above.

7.5 Third-Party Processors. We use the following third-party processors: Google (Gemini AI model inference), Supabase (database and authentication), Vercel (hosting and edge infrastructure), Razorpay (payment processing), Resend (transactional email), Inngest (background job processing), and PostHog (product analytics). Each processor is bound by appropriate data processing agreements.

7.6 International Transfers. Your data may be processed in countries outside your country of residence, including India, the United States, Singapore, and the European Union. By using the Platform, you consent to such transfers subject to appropriate safeguards.

8.1 AI Output. All Outputs generated by the Platform are produced by artificial intelligence systems and are intended solely as decision-support tools. SSUNDAR makes no representation, warranty, or guarantee as to the accuracy, completeness, reliability, fitness for a particular purpose, or legal compliance of any Output.

8.2 Not Professional Advice. Outputs should not be relied upon as a substitute for professional legal, financial, medical, regulatory, or other specialist advice. You are solely responsible for evaluating the appropriateness of any Output for your specific context and for any decisions made on the basis of such Outputs.

8.3 Professional Judgment. AI systems may produce outputs that are inaccurate, incomplete, biased, or inappropriate. You should apply appropriate professional judgment before implementing any recommendations contained in an Output. SSUNDAR accepts no liability for actions taken based on Platform Outputs.

8.4 "AS IS" / "AS AVAILABLE". EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE PLATFORM AND ALL OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SSUNDAR DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SSUNDAR DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY USER DATA OR OUTPUT WILL BE STORED WITHOUT LOSS OR CORRUPTION. YOU ARE RESPONSIBLE FOR RETAINING YOUR OWN COPIES OF ANY IMPORTANT INPUTS AND OUTPUTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU; IN SUCH CASES, OUR WARRANTIES ARE LIMITED TO THE MINIMUM EXTENT REQUIRED BY LAW.

9.1 Exclusion of Consequential Damages. To the maximum extent permitted by applicable law, SSUNDAR shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, or cost of substitute services, arising out of or in connection with your use of the Platform, even if SSUNDAR has been advised of the possibility of such damages.

9.2 Aggregate Cap. SSUNDAR's total aggregate liability to you for all claims arising out of or in connection with these Terms or your use of the Platform shall not exceed the total amount paid by you to SSUNDAR in the three (3) months immediately preceding the event giving rise to the claim, or INR 10,000, whichever is greater.

9.3 Service Availability. We do not guarantee uninterrupted, error-free, or completely secure access to the Platform. Scheduled maintenance, force majeure events, and third-party infrastructure failures may result in service interruptions. We will make commercially reasonable efforts to minimise downtime and provide advance notice of planned maintenance.

9.4 Third-Party Services. The Platform integrates with third-party services including AI model providers, payment processors, and infrastructure providers. SSUNDAR is not liable for the actions, errors, or omissions of these third parties.

You agree to indemnify, defend, and hold harmless SSUNDAR, its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform in violation of these Terms; (b) User Data you submit to the Platform; (c) your violation of any third-party rights, including Intellectual Property Rights; or (d) your violation of any applicable laws or regulations.

Our collection and use of personal data is governed by our Privacy Policy, available at app.ssundar.com/privacy-policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data practices described in the Privacy Policy.

We use cookies and similar tracking technologies for session management, security, and analytics. You may manage cookie preferences through the cookie consent banner displayed upon first visit. Rejecting non-essential cookies may affect certain Platform features.

12.1 By You. You may terminate your account at any time by using the account deletion feature in your dashboard or by contacting support@ssundar.com. Termination does not entitle you to any refund except as provided in Section 4.4.

12.2 By SSUNDAR. We may suspend or terminate your access to the Platform immediately and without notice if: (a) you breach any provision of these Terms; (b) we are required to do so by law; (c) we determine that your use of the Platform poses a security risk or causes harm to other users; or (d) your account has been inactive for more than 24 consecutive months.

12.3 Effect of Termination. Upon termination, your right to access and use the Platform ceases immediately. Sections 6, 7.3, 8, 9, 10, and 13 survive termination.

13.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (as applicable), without regard to conflict of law principles.

13.2 Jurisdiction. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

13.3 Informal Resolution. Before initiating formal legal proceedings, you agree to contact us at legal@ssundar.com to attempt to resolve the dispute informally. We will endeavour to resolve disputes within 30 days of receiving written notice.

13.4 Arbitration. If informal resolution fails, disputes shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 of India, with a sole arbitrator appointed by mutual agreement. The seat of arbitration shall be Hyderabad, Telangana. The language of arbitration shall be English.

We reserve the right to update these Terms at any time. Material changes will be communicated via email to your registered address and/or a prominent notice on the Platform, with at least 14 days notice before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Platform before the effective date.

15.1 Entire Agreement. These Terms, together with the Privacy Policy and any additional terms applicable to specific modules or services, constitute the entire agreement between you and SSUNDAR regarding the Platform and supersede all prior agreements.

15.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver. SSUNDAR's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

15.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without SSUNDAR's prior written consent. SSUNDAR may assign these Terms in connection with a merger, acquisition, or sale of assets.

15.5 Force Majeure. SSUNDAR shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, natural disasters, pandemics, government actions, internet outages, or third-party infrastructure failures.

15.6 No Agency. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and SSUNDAR.

15.7 Language. These Terms are written in English. In the event of any conflict between translated versions and the English version, the English version prevails.
